By accessing our site (www.hugsandgifts.com) you agree to the privacy policy and terms of use of Neiva Group LLC as the sole owner and operator of this website. For clarification purposes the terms “we” or “us” imply Neiva Group LLC. We respect the privacy of all users of the Site and Services, and unless otherwise set forth in this Privacy Policy or in any applicable Terms of Use, disclaimer or legal statement related to the Site, and/or Services, we will not release your private, password protected Personal Information without your permission, except as necessary to perform the Services.

1. Personal Information

Personal Information is unique information that identifies you. Personal Information includes information such as your name, email address, and/or telephone number. The personally identifiable information may include your profile account at Facebook website. All these personal information data will remain private and not publicly available on the Site.  

We will also ask you for financial information for payment purposes, including, but not limited to your billing name, billing address, shipping address, credit, debit, bank card or PayPal account information; or any other information that we, in our sole discretion, or, in case is requested by our third party payment processor deem appropriate for payment processing. However we will not store your Payment Information on our database.  Once you provide us with your Payment Information to us, we will forward the information to our third party payment processor, who will only use your Payment Information to process your payment of the ordered products. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. We encourage our customers to keep a copy of your transactions with our company.

Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

You can review and update your private, password protected Personal Information and Payment Information that you provide us in your user account.  Please be aware that even after your request for a change to your Personal Information is processed, we may, for a time, retain residual information about you in backup and/or archival copies in our database.  Additionally, you can also close your user account through the Site. If you close your Registered Account, we will remove your private, password protected Personal Information from our database. At that point we will delete ALL your information from our database.

 2. Sharing and Disclosure of Personal Information

Except as otherwise described in this Privacy Policy and the Terms of Use, we will not disclose private, confidential Personal Information to any third-party unless we believe that disclosure is necessary to: (i) comply with the law, conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by us, whether or not a response is required by applicable law; (ii) enforce the Agreement or to protect our rights, property and interests (or of an Affiliate); or (iii) protect the safety of members of the public and Users.

In addition, we disclose information to companies and individuals we employ or contract with to perform functions on our behalf. Examples include, but are not limited to, hosting our web servers, analyzing data, providing marketing assistance and processing payments for the ordered products. 3. Log Files

When you visit the Site we may receive the URL of the website from which you came, and when you leave the Site, we may receive the URL of the website to which you are going.  We also may receive the IP address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and type of web browser you are using, email patterns, as well as the name of your ISP.  This information can be used to analyze overall trends to help us improve the Services and Marketing Strategy.  We, as the owner of the website,  as the same as our server provider and our payment processor entities  have the capability to collect navigation data about you as the visitor to the website. This information has the only objective to improve our services and maximize our marketing strategies. The linkage between your IP address and your Personal Information is not shared with third parties without your permission unless otherwise required by law. We may access information about you from third-party sources and platforms. This may include your username and connection list for Facebook if you access third-party social networking services through the Site.

4. Protecting Your Personal Information

Neiva Group, LLC diligently makes every effort to ensure that your information is secure on its servers by using industry standard security technology, such as encryption and firewalls on both our main and backup servers. Unfortunately, information transmitted via the Internet is not completely secure. As a result,  Neiva Group, LLC cannot guarantee the security of any information you transmit to us, and you do so at your own risk. We expressly disclaim any liability for any unauthorized access to or use of our secure servers and/or any and all Personal Information stored therein, and you agree to hold Neiva Group, LLC harmless for any loss or damages that may result therefrom. It is your responsibility to use firewalls, malware protection and antivirus vendors/softwares/programs  to protect your personal information that is sent from your side.

5. Children Under Age 18

Registered Users must be aged 18 years or older. Unless we have permission from the legal guardian of a user who is under 18 years of age, we do not allow persons under age 18 to create a user account; nor do we knowingly collect or solicit Personal Information from anyone under the age of 18. In the event that we learn that information has been collected from a child under age 18 without verification of parental or guardian consent, that information will be deleted as quickly as possible.       7. Account Registration and User responsibilites:

As a condition of use, you hereby agree not to use the Site for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by Neiva Group LLC (each an “Unauthorized Use”). By way of example, and not as a limitation, you agree not to:

• Provide false or inaccurate Registration Data;

• Post, email, transmit, upload or otherwise make available any material that contains software viruses or any other computer code, files or programs designed or functioning to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
